Can I build an Accessory Dwelling Unit (ADU) on my property?

Many counties and municipalities in Florida now allow Accessory Dwelling Units (ADUs) such as garage apartments, in-law suites, or backyard cottages. However, your Association’s governing documents typically take priority within the community.

Most HOA and condominium declarations in Florida do not permit ADUs, as they can conflict with restrictions on single-family use, leasing, parking, or density. Even if your county or city allows them, your Association’s restrictions may prohibit construction.

Before making any plans, please:

  • Review your Association’s Declaration and architectural guidelines.
  • Submit an ARC/ACC request for any proposed addition or structure.
  • Confirm with the Board whether ADUs are permitted.

Building an ADU without approval would be considered a violation and could require removal at your expense.
