What You Need to Know..

If you’re planning to sell your home, here are a few important things to understand about what is — and isn’t — provided by Sunshine Association Partners on behalf of your Association

1. Disclosure Summary (Generally your realtor’s responsibility)

Florida law requires sellers to provide a Disclosure Summary to buyers before signing a sales contract. This notice explains that your property is in a deed-restricted community, that membership in the Association is mandatory, and that assessments are required.

2. Estoppel Certificate (Association responsibility) 

Before closing, the title company or law firm handling the sale will order an Estoppel Certificate from Sunshine Association Partners.

Other Helpful Reminders

  • If your community has keys, fobs, gate remotes, or parking passes, plan to transfer those to the buyer at closing.
  • Check your governing documents for any rental restrictions or buyer approval requirements that may apply to new buyers.
  • This document confirms your account balance, any unpaid or prepaid assessments, and whether special assessments are due.
  • Title companies use the estoppel to ensure all financial matters with the Association are settled at closing. 
  • Florida statute requires Associations to provide this upon request; a statutory fee applies.

📌 Important: An estoppel certificate is usually required for refinances. If you are refinancing your home loan, your lender or title company will submit the estoppel request to our office in the same way they would for a sale.
